1. Use of Services 1.1. Eligibility: By using our services, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into this Agreement. 1.2. License: Subject to the terms and conditions of this Agreement, the Company grants you a limited, non-exclusive, non-transferable, and revocable license to access and use our website and services for your personal or internal business purposes.

2. Dropshipping Business Model 2.1. Relationship: You acknowledge and agree that Nova Nourish operates as a dropshipping business using the Wix platform. We source and supply skincare products, including those containing chemicals, from third-party suppliers, including suppliers based in China, and fulfill orders on your behalf using the Wix dropshipping functionality. 2.2. Supplier Terms: You agree to abide by the terms and conditions set forth by Nova Nourish's third-party suppliers. We are not responsible for any issues arising from your interactions with suppliers, including but not limited to product quality, shipping delays, or disputes.

3. Product Orders and Sales 3.1. Orders: All orders placed through the Nova Nourish website are subject to acceptance and availability. We reserve the right to refuse or cancel any order at any time for any reason, including but not limited to product availability, errors in product information, or suspected fraud. 3.2. Pricing and Payment: Prices for Nova Nourish products are subject to change without notice. Payment for all orders must be made in full at the time of purchase. We accept payment via Credit card/debit, Apple Pay, Google Pay, Affirm, and Afterpay. 3.3. Shipping: We will make every effort to ship orders promptly. However, we are not responsible for delays in shipping or delivery beyond our control, including but not limited to carrier delays, customs delays, or natural disasters.

4. Returns and Refunds 4.1. Return Policy: Nova Nourish offers a 14-day return policy for eligible products. To be eligible for a return, the product must be unused, unopened, and in its original packaging. Certain products may not be eligible for return due to health and safety regulations. For any undamaged product, simply return it with its included accessories and packaging along with the original receipt (or gift receipt) within 14 days of the date you receive the product, and we will exchange it or offer a refund based upon the original payment method. In addition, please note the following: (i) Products can be returned only in the country in which they were originally purchased; and (ii) the following products are not eligible for return: Eggplant Mud Cream. 4.2. Refunds: Refunds will be issued to the original form of payment within 30 business days of receiving the returned product. Shipping and handling fees are non-refundable.

5. Product Liability and Regulatory Compliance 5.1. Product Safety: Nova Nourish takes product safety seriously and endeavors to ensure that all skincare products sold through our platform comply with relevant regulations and standards. However, we make no warranties or representations regarding the safety or efficacy of any product. 5.2. User Responsibility: You acknowledge and agree that you are responsible for ensuring compliance with all applicable laws, regulations, and standards related to the sale and distribution of skincare products in your jurisdiction. 5.3. Proposition 65 Compliance: Some products may contain chemicals known to the State of California to cause cancer, birth defects, or other reproductive harm under Proposition 65. Warnings are provided where applicable.

6. Intellectual Property 6.1. Ownership: All content, trademarks, logos, and other intellectual property rights displayed on the Nova Nourish website are the property of the Company or its licensors and are protected by copyright and other intellectual property laws. 6.2. Limited License: You are granted a limited, non-exclusive, and non-transferable license to use Nova Nourish's intellectual property solely for the purpose of accessing and using our website and services in accordance with this Agreement.

7. Disclaimer of Warranties 7.1. We make no representations or warranties of any kind, express or implied, regarding the accuracy, reliability, or completeness of any information provided on the Nova Nourish website or through our services. 7.2. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

8. Limitation of Liability 8.1. In no event shall Nova Nourish or its affiliates be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of our website or services, including but not limited to lost profits, lost revenue, or loss of data. 8.2. Our total liability to you for any claim arising out of or relating to this Agreement or your use of our website or services shall not exceed the total amount paid by you to us in the 12-month period preceding the event giving rise to the claim.

9. Indemnification You agree to indemnify, defend, and hold harmless Nova Nourish and its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your use of our website or services, your violation of this Agreement, or your violation of any rights of a third party.

10. Governing Law and Dispute Resolution This Agreement shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any dispute arising out of or relating to this Agreement shall be resolved exclusively by the state or federal courts located in [Your Jurisdiction].
